Problems with Port State Control
Deficiencies
If there are problems or discussions about deficiencies please write an email to ism@see-bg.de including a short summery of the deficiencies raised by port state control and your different kind of view. The BG Verkehr will get an overview about the situation and if necessary will contact the Port State Control Authority.
Detentions
Due to Flag state requirements the company has to inform the BG Verkehr about every detention, no matter if the detention seems to be correct.
If the company wants to claim the detention, there are two possibilities.
1. If the detention seems to be unjustified the Company could appeal against the detention on its own. Information about the deadline and procedure of appeals can be found on the websites of the MoUs.
2. In cases the Company disagrees with the detention and does not wish to appeal on its own, it can file a petition to the BG Verkehr (Mail ). The Ship Safety Division will assess the circumstances which have caused the detention and, if the grounds for detention seem unjustified, will file a request to the Port State Authority to reconsider the detention.
If the Port State Authority rejects the request there is the further possibility to send a request for review to the competent MoU secretariat. It is to be noted that the final opinion of the review panel members is not binding for the Port State.
